The short version

  • You must be 18 or over and legally able to enter a contract.
  • Be honest about who you are. One account per person. No impersonation, no stolen photos.
  • You keep ownership of what you post; you give us a licence to display it so the service can work.
  • No sexual services, no compensated dating, no nudity, no scams, no harassment, and absolutely nothing involving a child.
  • We do not run criminal background checks on members and we cannot guarantee anyone's identity or intentions. Your safety when you meet someone is your responsibility — read our safety guidance.
  • Paid plans are bought through Google Play. A monthly subscription renews until you turn off renewal in Google Play; a prepaid month simply ends.
  • These Terms are governed by Sri Lankan law. Nothing in them takes away rights you have that cannot be excluded by law.

1Who these Terms are with

Hamuwemu is owned and operated by Infinite Global Solutions (Pvt) Ltd, a company incorporated in Sri Lanka under registration number PV 00269216, with its registered office at No. 99, Wendesiwaththa, Welisara, Ragama 11010, Sri Lanka (“Hamuwemu”, “we”, “us”, “our”).

“You” means the person using the service. “Service” means the Hamuwemu mobile applications, the hamuwemu.lk website and every feature we provide through them.

2Accepting these Terms

You accept these Terms when you create an account, tick the box to agree, subscribe to a paid plan, or otherwise use the Service. If you do not accept them, do not use Hamuwemu.

These Terms incorporate, and you also accept, the following documents:

This is an electronic contract. Under the Electronic Transactions Act No. 19 of 2006 it is not invalid merely because it was formed electronically. We record the version of the Terms you accepted, the date and time, and the account that accepted them, and that record is evidence of your acceptance.

3Who may use Hamuwemu

By using the Service you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into a binding contract, and you are not barred from using the Service under any applicable law;
  • you are using Hamuwemu for yourself, as an individual, and not on behalf of anyone else;
  • you have never been convicted of, or pleaded guilty to, an offence involving sexual misconduct, the abuse or exploitation of a child, human trafficking, or violence against another person, and you are not subject to any court order restricting your contact with other people; and
  • we have not previously terminated or banned your account, unless we have given you written permission to return.

We do not carry out criminal background checks or identity checks against government records. Our verification steps confirm that an account is operated by a real person whose photographs appear to be their own — nothing more. See section 12.

4Your account

  • Accuracy. The information on your profile must be true and about you. Do not misstate your age, name, marital status, occupation, qualifications or intentions.
  • One account. One person, one account. Do not create a second account to get around a restriction, a block or a ban.
  • Photographs. Your photographs must be of you, recent, and yours to use. No photographs of other people and no images taken from the internet. A child may appear only incidentally in a family photograph — never as the subject of a photograph and never in your main profile photograph.
  • Security. Keep your password and one-time codes private. You are responsible for activity on your account. Tell us immediately at support@hamuwemu.lk if you suspect unauthorised access.
  • One phone at a time. Your account can be signed in on one phone at a time. If you sign in on another phone, the first phone is signed out and we send it a notice. If you did not sign in yourself, change your password and tell us at once at support@hamuwemu.lk.
  • No transfers. You may not sell, rent, share or transfer your account, and it is personal to you.
  • Verification. Every account must verify its mobile number. You must complete selfie verification, reviewed by a member of our team, before you can send your first message. We may ask you to re-verify at any time, and may restrict features of an account that has not verified.

5Your content

You keep ownership of the photographs, text, voice notes and other material you put on Hamuwemu (“your content”).

So that we can actually operate the Service, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, reformat, adapt for display, transmit and show your content — to the members you have chosen to show it to, and for the purpose of running, securing, moderating and backing up the Service. The licence lasts while your content is on Hamuwemu and for the short period afterwards needed to remove it from live systems and backups.

We will not use your photographs or profile in advertising or promotional material without asking you separately and getting your agreement first.

You confirm that you own your content or have the rights to post it, that posting it does not break any law or anyone else's rights, and that any other person shown in it has agreed to appear.

We may remove content that breaks these Terms or our Community Guidelines, and we may refuse to publish it in the first place.

6Our content and intellectual property

The Hamuwemu name, logo, app, website, software, designs, text and all other material we create are owned by or licensed to Infinite Global Solutions (Pvt) Ltd and protected by the Intellectual Property Act No. 36 of 2003 and other laws. We grant you a personal, limited, revocable, non-transferable licence to use the app for its intended purpose. You may not:

  • copy, modify, translate, distribute, sell or create derivative works from any part of the Service;
  • reverse engineer, decompile or disassemble the app, except to the extent the law expressly permits;
  • scrape, crawl, harvest or index member profiles, photographs or data by any automated means;
  • use bots, scripts or automated tools to interact with the Service;
  • copy or reuse another member's photographs or profile content anywhere, on or off Hamuwemu;
  • use our name, logo or brand without our written permission; or
  • interfere with, probe or overload our systems, or try to gain unauthorised access to them. Doing so may be an offence under the Computer Crime Act No. 24 of 2007.

7Rules of conduct

Our Community Guidelines set out the rules in full and form part of these Terms. In summary, you must not use Hamuwemu to:

  • post, request or transmit any sexual content involving a minor, or attempt to contact, groom or sexualise a minor in any way — this results in immediate, permanent removal and a report to the authorities;
  • post pornography, nudity or sexually explicit content, or solicit sex;
  • offer, seek or arrange sexual services, escorting, prostitution, or compensated dating or any arrangement where one person is expected to provide money, gifts or financial support;
  • harass, threaten, stalk, bully, intimidate or defame anyone, or incite hatred or violence against a person or group;
  • run a scam of any kind — romance fraud, investment or cryptocurrency schemes, fake emergencies, requests for money, gift cards or top-ups, phishing for passwords or one-time codes;
  • impersonate anyone, use another person's photographs, or create a false or misleading profile;
  • share another person's private information, photographs or messages without their consent, including screenshots of Hamuwemu chats;
  • record a call or conversation unlawfully, or distribute intimate images of anyone without their consent;
  • spam, advertise, recruit, campaign politically, or promote unrelated products, services or platforms;
  • post anything unlawful, or anything that would be a “prohibited statement” under the Online Safety Act No. 9 of 2024;
  • sell, buy or promote illegal goods or services, drugs, weapons or gambling; or
  • evade verification, blocking, moderation or a ban.

8Messaging, calls and privacy between members

Hamuwemu provides in-app chat and voice or video calls so you can get to know someone without giving out your personal number. Take the time you need before moving to another platform or meeting.

  • We do not record or listen to your calls. We keep call records — who called whom, when, and for how long — to operate the service and to prevent abuse.
  • Your private messages are end-to-end encrypted. They are encrypted on your device and can only be read on the devices of the two people in the conversation — we hold the encrypted text and not the keys, so we cannot read your messages and we cannot scan them. When you report a message, a copy of it is sent to us from your device so that a reviewer can see exactly what you saw. Who messaged whom and when, and anything posted on a profile, is not encrypted. Our Privacy Policy explains this.
  • Respect consent and boundaries. If someone stops replying, stop messaging. Do not pressure anyone into calling, meeting, sending photographs or sharing contact details.
  • Do not record, screenshot or share another member's messages, images or calls without their permission.

9Subscriptions and payment

Hamuwemu is free to use in its core form. Paid plans add optional features. Full details are in the Subscription & Cancellation Policy and the Refund Policy, which form part of these Terms. In summary:

  • Paid plans are bought through Google Play, which takes the payment. Google Play shows the price, and whether the plan renews, before you pay.
  • You can choose a monthly subscription, which renews automatically each month at the then-current price until you turn off renewal in Google Play, or a prepaid month, which you pay for once and which never renews.
  • Refunds can be granted by Google under its own rules, or by us under our Refund Policy.
  • Price changes. We reserve the right to change our subscription prices. We will give you at least 30 days' notice before an increase takes effect on your plan, explain the reason for it, and tell you how to cancel. An increase never applies retroactively to a period you have already paid for, and where Google Play or the law requires your consent to continue billing, we will obtain it.
  • A monthly subscription lives in your Google account. Turn off renewal in Google Play before you delete your Hamuwemu account. If a renewal is charged after your account has been deleted, we will refund it on request.
  • Hamuwemu for iOS has not yet been released. When it is, purchases on an iPhone or iPad will be billed by Apple through the App Store.

10Business and professional profiles

Hamuwemu allows verified members and businesses to promote lawful services through a business profile. This is a secondary feature and is governed by the Professional Services Policy. Anything you agree with another member about their services is between the two of you. We are not a party to it, we do not supply those services, and a verification badge is not an endorsement, a recommendation or a guarantee of quality, qualification or licensing.

11Moderation, suspension and appeals

We may review content and accounts using automated tools and human moderators. Where we consider that these Terms, our Community Guidelines or the law have been broken, or where it is necessary to protect members, we may — with or without notice, and in proportion to what has happened:

  • issue a warning, remove or hide content, or reject a profile change;
  • limit features such as messaging, calls, photo sharing or discovery;
  • suspend the account while we investigate;
  • terminate the account permanently and ban the person from Hamuwemu; and
  • preserve evidence and report the matter to the authorities where the law requires it or safety demands it.

Serious matters — sexual content involving a child, credible threats of violence, trafficking, or the non-consensual sharing of intimate images — result in immediate permanent removal without prior warning.

Appeals. If we act against your account, we will tell you what happened, so far as we lawfully and safely can. You may appeal within 30 days using the in-app appeal form or by writing to support@hamuwemu.lk. A person who was not involved in the original decision will review it, and we aim to respond within 14 days. Our appeal decision is final as a matter of contract, but it does not affect any legal right you have.

If you paid for a subscription and we terminate your account for a serious breach of these Terms, we may end the subscription without a refund for the remaining period, to the extent the law allows.

12Safety: what we do and what we cannot do

Please read this carefully

We verify that accounts are operated by real people and we moderate content, but we cannot and do not guarantee the identity, age, marital status, background, conduct or intentions of any member. We do not conduct criminal background checks. Verification is not a safety guarantee.

You are responsible for your own interactions and decisions, online and in person. Before you meet anyone:

  • get to know them in the app first, and be wary of anyone who rushes you off the platform;
  • never send money, gift cards, mobile top-ups or cryptocurrency, and never share your passwords, one-time codes, NIC, bank or card details;
  • meet in a public place, arrange your own transport, and keep your belongings with you;
  • tell a friend or family member where you are going, with whom, and when you expect to be back; and
  • leave if you feel uncomfortable, and report the person to us.

13Reporting problems

Every profile, chat and call has Report and Block controls, and you can report a single message or photo by pressing and holding it — a copy of what you saw is sent to us from your device. You can also use Report a concern in Settings or Help, or write to support@hamuwemu.lk, or for anything involving a child, to childsafety@hamuwemu.lk. We review reports promptly and prioritise those involving risk to a person's safety. Copyright and other content complaints are handled under our Copyright & Content Complaints Policy.

14Availability and changes to the Service

We work to keep Hamuwemu available, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, or the whole Service, for maintenance, security, legal or business reasons. Where a change materially reduces what you have paid for, we will give you reasonable notice and, where appropriate, a pro-rata refund of the unused portion of your subscription.

15Disclaimers and our liability to you

Except where the law says otherwise, the Service is provided “as is”. We do not promise that you will find a friend, a partner or a spouse, that any member is suitable for you, or that any professional service advertised on Hamuwemu will meet your expectations.

To the fullest extent permitted by law, we are not liable for:

  • the conduct of any member, online or offline, including anything that happens when you meet someone;
  • the accuracy of information a member provides about themselves;
  • any agreement you make with another member or a business profile;
  • loss of profit, loss of opportunity, loss of data, or any indirect or consequential loss; or
  • failures caused by events outside our reasonable control.

Where we are liable to you, our total liability for all claims arising in any 12-month period is limited to the greater of the amount you paid us in that period and LKR 10,000.

Your rights that cannot be excluded

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under Sri Lankan law — including your rights as a consumer under the Consumer Affairs Authority Act No. 9 of 2003.

16Your responsibility to us

If a third party brings a claim against us because of something you did on Hamuwemu — content you posted, a right you infringed, a law you broke or a term of this agreement you breached — you agree to be responsible for the reasonable losses, damages and legal costs we incur as a result. We will tell you promptly about any such claim and give you a reasonable opportunity to be involved in the response.

17Ending this agreement

You may stop using Hamuwemu and delete your account at any time, in the app or at hamuwemu.lk/account-deletion. We may end this agreement on reasonable notice, or immediately where you have seriously breached it or where we must do so for legal or safety reasons.

When this agreement ends, your licence to use the app ends, your profile stops being visible, and your data is handled as described in our Privacy Policy and Account Deletion & Data Rights. The sections on your content licence (while removal completes), intellectual property, liability, indemnity and governing law survive.

18Changes to these Terms

We may update these Terms. If a change is material, we will give you at least 14 days' notice in the app or by email before it takes effect, and we will ask you to accept the new version. If you do not accept it, you should stop using Hamuwemu and may delete your account; where you have paid for a subscription period you cannot use as a result, we will refund the unused portion. Minor changes — corrections, clarifications, new contact details — take effect when published.

19Additional terms for app store users

19.1 Apple App Store

Not yet applicable. Hamuwemu for iOS has not been released. From the date it is available on the App Store, the following will apply to anyone who downloads it from there, in addition to these Terms:

  • This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection law.
  • We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • Your use of the app must comply with the Apple Media Services Terms of Service.

19.2 Google Play

If you downloaded Hamuwemu from Google Play, your use of the app is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.

20Governing law and resolving disputes

These Terms and any dispute arising out of them are governed by the laws of Sri Lanka. Subject to the paragraph below, the courts of Colombo have jurisdiction.

Talk to us first. Most problems are resolved quickly. Please write to legal@hamuwemu.lk setting out the issue and what you would like us to do. We will respond within 21 working days and try in good faith to resolve it with you before either of us goes to court.

If you are a consumer, you may also take a complaint to the Consumer Affairs Authority (caa.gov.lk), and a data protection complaint to the Data Protection Authority of Sri Lanka (dpa.gov.lk). Nothing in these Terms prevents you from bringing proceedings in the courts of the country where you live if the law of that country gives you that right.

21General

  • Entire agreement. These Terms and the documents they incorporate are the whole agreement between us about the Service.
  • Severability. If a court finds any part unenforceable, the rest continues in force.
  • No waiver. If we do not enforce a right immediately, we do not give it up.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours to a company that acquires our business, provided your rights are not reduced.
  • Notices. We contact you through the app, by push notification, or at the email address or mobile number on your account. You contact us at the addresses below.
  • Language. These Terms are published in English. If we publish a Sinhala or Tamil translation and the versions differ, the English version governs.
  • Force majeure. Neither of us is liable for a failure caused by events beyond reasonable control.
