1What this policy covers
This policy covers complaints about content on Hamuwemu that we can see — profiles, photographs and business profiles — and about private messages that have been reported to us. It covers complaints that such content:
- infringes copyright or another intellectual property right you own or represent;
- uses your photographs, likeness, name or identity without your permission — including a profile pretending to be you;
- discloses your private information without your consent, including intimate images shared without consent; or
- is otherwise unlawful, including content that is defamatory or that a Sri Lankan authority has identified as a prohibited statement under the Online Safety Act No. 9 of 2024.
Complaints about conduct rather than content — harassment, scams, fake profiles used to deceive — are handled faster through the in-app Report control and our Community Guidelines. Use whichever route fits; we will redirect it internally if you choose the wrong one.
The process here is one we offer voluntarily, under our contract with our members. It is not a statutory notice-and-takedown procedure, and using it does not affect any right you have to go to court or to the authorities.
2How to send us a complaint
Email legal@hamuwemu.lk with the subject line “Content complaint”, and include all of the following. A complaint missing any of it will be delayed while we come back to you.
- Your details — full name, postal address, email address and telephone number.
- Who you are — whether you are the rights owner or the person depicted, or are authorised to act for them, and in what capacity.
- What is yours — identify the work, photograph, trade mark or identity concerned, and tell us where the original can be seen if it is published anywhere.
- Where it is on Hamuwemu — the username, the profile or business profile, the specific photograph, and a screenshot. Be precise enough that we can find it without guessing. Private messages are end-to-end encrypted and we cannot see them: if the content was sent to you in a private message, report that message in the app, which sends us a copy from your device.
- Why it is unlawful — a short explanation, including the fact that you have not given permission.
- Two statements, in these words or words to the same effect:
- “I believe in good faith that the use of the material described is not authorised by the rights owner, its agent or the law.”
- “The information in this complaint is accurate, and I am the owner of the right concerned or am authorised to act on the owner's behalf.”
- Your signature — typed is enough — and the date.
If your complaint concerns an intimate image or anything involving a child, describe where it is rather than attaching it. Anything involving a child should go to childsafety@hamuwemu.lk and is handled under our Child Safety Standards, immediately and with priority over everything else.
3What we do
- We acknowledge your complaint within 3 working days.
- We assess it. Where it is clearly well-founded, or where leaving the content up risks serious harm, we remove or hide the content immediately while we look further.
- We tell the member whose content it is what has been removed and why, and we give them a copy of the complaint with your contact details redacted unless the law requires otherwise.
- We give you a decision, normally within 14 days of receiving a complete complaint.
- Where the law requires us to act on a lawful notice or order within a shorter period, we do so within that period.
Non-consensual intimate images and impersonation profiles are removed on sight, without waiting for the process above to complete.
4If your content was removed and you disagree
Write to legal@hamuwemu.lk within 30 days with the subject line “Content complaint — response”, and include your name and contact details, what was removed and where it was, and why you believe you are entitled to use it — for example that you own it, that you have a licence, that the person depicted consented, or that it was removed by mistake.
We will review it, and pass a copy to the complainant. If the dispute turns on facts we cannot resolve — competing claims to the same photograph, for example — the content stays down until the two of you resolve it or a court decides. We are not a tribunal and we do not adjudicate ownership.
5Repeat infringers
We keep a record of complaints upheld against each account. An account that repeatedly posts infringing or unlawful content will be restricted and then permanently terminated. A single serious case — posting someone's intimate images, or a profile impersonating a real person to deceive — can result in permanent termination the first time.
6Complaints made in bad faith
Do not use this process to remove content you simply dislike, to attack a competitor's business listing, or to harass someone. Knowingly making a false complaint is a breach of our Terms of Use, may cause you to lose your own account, and may expose you to liability to the person whose content you had removed.
7Notices from authorities and courts
Notices, orders and directions from a Sri Lankan court, the Sri Lanka Police, the Online Safety Commission or another authority acting within its powers should be sent to legal@hamuwemu.lk and to our registered office. We review each one, act within the period the law requires, and record what we did. Our approach to those requests, and when we notify the member concerned, is set out in our Law Enforcement Request Guidelines.
